Online certificates

In using Certificates Online, you accept and understand that:

1. Certificates are costed and processed according to Port Macquarie-Hastings Council’s current Fees and Charges.
2. It is your responsibility to accurately identify and verify the identification of the land subject to the certificate. No refund will be issued if the wrong property was selected or previously ordered once your request has been finalized.
3. It is your responsibility to verify that a property is connected to Council’s water supply prior to ordering a Water Usage Certificate or an Additional Water Meter Read. No refund will be issued if the property is not connected to Council’s water supply.
4. Where delivery by email is selected, you are responsible for specifying the correct email address. Port Macquarie-Hastings Council does not verify the validity of email addresses and whether certificates have been received.
5. Certificates Online relies on the internet to receive applications and/or deliver certificates via email (where selected). Access to the internet by users of the service is dependent on numerous factors, technologies and systems, many of which are beyond Port Macquarie-Hastings Council’s authority and control. Port Macquarie-Hastings Council will not be liable or responsible for:
   1. Any inability of yours to access the internet;
   2. Emails not being delivered promptly, or at all; or
   3. Certificates being or becoming corrupted or damaged in their passage across the internet by reason of any factor beyond Port Macquarie-Hastings Council’s authority and control.
6. Port Macquarie-Hastings Council excludes any liability to you or any other parties arising from or related in any way to:
   1. Any act or omission of Port Macquarie-Hastings Council in good faith and without negligence;
   2. The failure of Port Macquarie-Hastings Council to receive any instructions, information or document by a particular time or at all unless the failure was the result of a negligent act or omission of Port Macquarie-Hastings Council; or
   3. Any act or omission of a third party including, without limitation, a telecommunications or internet service provider.

 All matters relating to this service are governed by the laws of the State of New South Wales. 

A section 10.7 Planning Certificate was previously known as a Section 149 Certificate. The Certificate will provide you with information regarding the development potential of a parcel of land. There are 2 types of Section 10.7 Planning Certificates.

1. A Section 10.7(2) certificate shows the zoning of the property, its relevant state, regional and local planning controls and other property constraints such as land contamination, level of flooding and bushfire prone land.
2. A Section 10.7(2) and 10.7(5) certificate provides the same information as above but also includes other factors such as advice from other authorities and certain information that Council holds on a property that is relevant to the land but is not disclosed in a Section 10.7(2) certificate.

• Sewer Service Junction
• Section 603 Rating Certificate
• Water Usage Certificate
• Additional Water Meter Read
• Outstanding notices or orders
  - Section 735A (Local Government Act)
  - Clause 41 Schedule 5 (Environmental Planning and Assessment Act)

*House/internal drainage diagrams in many cases are not readily available or we cannot locate the diagram, sometimes due to the age of the record. If your request relates to a property sale and the requirement to have a house/internal drainage plan with a contract of sale under the Conveyancing Act, Council can provide you with a letter advising these records are not available in the ordinary course of administration. If your enquiry is of this nature, please contact Council dev.documents@pmhc.nsw.gov.au after lodging your request via our online certificates portal. If the diagram can’t be located following a search of Council records, we won't be able to offer a refund.
