Planning Proposal Policy
Adopted - 11 December 2019 and amended 20 April 2023
The Planning Proposal Policy was adopted by Council at the Ordinary meeting 11 December 2019 and came into effect on 5 February 2020.
This Planning Proposal Policy was reviewed in accordance with Section 4(f)(ii) of this Policy, which states as follows:
"A review of the Policy within 12 months of any general election of the Council. A review of this Policy can be initiated outside of this timeframe at the discretion of the General Manager to ensure that any relevant changes to legislation or guidelines that affect Planning Proposals are incorporated into this Policy."
This review also incorporated the requirements of the Department of Planning and Environment’s (DPE) new Local Environmental Plan Making Guideline (the Guideline) which came into effect on 15 December 2021 and was amended 22 September 2022.
This amended Policy was adopted by Council at the Ordinary meeting 20 April 2023.
This Policy informs and educates the community regarding the process and requirements for the submission of Planning Proposals to amend the Council’s Local Environmental Plan (LEP) in accordance with the DPE’s Guideline and any additional requirements of Council.
The Guideline seeks to better explain the Planning Proposal system to rezone land and implements new changes to improve this process. A key improvement is clearly defined process timeframe expectations to ensure timely assessment of planning proposals, while still ensuring high quality and placed based planning outcomes.
A Planning Proposal is a document that explains the intended effect of a proposed LEP or an amendment to the LEP and sets out the justification for making that plan or amendment. Council, as a Planning Proposal Authority under the NSW Environmental Planning and Assessment Act 1979, is required to assess and prepare planning proposals to amend the LEP.
