Canal Maintenance Plan and Maintenance responsibilities

Canal Maintenance Plan - 2017

In 2017 Council engaged Royal Haskoning DHV to produce an updated  Canal Management Plan2MB pdf(PDF, 2MB) (CMP) which included outlining the current condition of the canals, all maintenance works required, and an updated 10 year maintenance schedule for the canals. As part of the CMP a hydrographic survey was conducted providing an accurate representation of the canal bed depth and shape. A comparison was made with the original design specifications and found that the current canal bed profile required dredging works. As part of Councils commitment to providing safe and effective assets for the community, dredging works are considered to be the priority maintenance activity as part of the comprehensive maintenance list produced from the 2017 CMP.

The CMP has identified that areas of the canal bed depths have been altered due to sedimentation, tidal movements, boat wash, etc and require cut and fill by dredging practices to provide sufficient depth for safe boat navigation. 

Council is in the process of preparing canal bed maintenance dredging. Refer to Planned Maintenance Dredging for more information.

Maintenance Responsibilities

In relation to the general maintenance of the canals the following applies:

  • The private property boundary is approximately 2.1 metres out from the revetment. There is a covenant on the title of all those properties stating that individual property owners are responsible for the maintenance and repair of the revetment wall and 2.1 metres of the adjacent beaches to the property boundary. A covenant (legal requirement), placed on each property title, states that individual property owners are responsible for the maintenance, and repair if necessary, of the revetment wall. This covenant also gives Council the power to carry out any necessary maintenance if the property owner fails to do so and to charge the cost of that maintenance to the property owner.
  • The beach zone and waterway itself, outside the 2.1 metre property boundary from the revetment wall, is vested in the Council and the Council has accepted responsibility for maintaining the beach zone, waterways and flood structures.

Replacement of sand within a Canal

Should the owner of a property within the Settlement Shores Canals wish to reinstate the sand beach at the rear of the property, the following applies: Such works are possible under the following arrangements:

  • Sand may be removed from the canal and placed on the beaches to renourish eroded sand deposits using hand-held tools/implements only during

    low tide. Such works are to be undertaken above the standing water level at the time in order to minimise the potential for water pollution.

  • If mechanical tools/implements (i.e. excavators/bobcats etc.) are proposed to be utilised, works are subject to lodging a Development Application with Council as a means of ensuring the potential impacts are assessed and minimised. No materials are to be imported and placed within the canals without the prior approval of Council.

Boat Ramps, Jetties and Pontoons

If property owners wish to construct private structures within the waterway, such as boat ramps and jetties, then they are required to get the necessary building approvals from Council. The owners of such structures are required to maintain them and if required undertake repairs. As these private structures are on public land owners are also responsible for having appropriate public liability insurance to cover their structures.
